Copyright Policy
1. Overview
HappyMod respects the intellectual property rights of developers, publishers, creators, and copyright owners. We are committed to maintaining a platform that supports lawful use, responsible content sharing, and prompt handling of copyright concerns.
This Copyright Policy explains how HappyMod addresses copyrighted content, what types of content may be restricted or removed, and how copyright holders may request review or removal of allegedly infringing material.
By using HappyMod, users agree to comply with this Copyright Policy and all applicable intellectual property laws.
2. Respect for Intellectual Property Rights
HappyMod recognizes that software, games, applications, logos, images, text, videos, audio, databases, source code, and other creative works may be protected by copyright, trademark, or other intellectual property laws.
Users may not upload, submit, share, request, distribute, or promote content that infringes the rights of others. This includes, but is not limited to:
- Unauthorized copies of copyrighted applications or games
- Modified files that unlawfully bypass licensing, payment, access controls, or digital rights management
- Content that removes or alters copyright notices
- Reuploads of paid apps, premium content, or exclusive content without authorization
- Unauthorized use of protected artwork, icons, branding, screenshots, music, videos, characters, or written materials
- Content that falsely claims affiliation with, endorsement by, or ownership from another developer, publisher, or rights holder
HappyMod may remove or restrict access to content that violates this Policy, our content standards, or applicable law.
3. User Responsibility
Users are responsible for the content they submit, upload, share, or otherwise make available through HappyMod.
Before submitting content, users must ensure that they:
- Own the content, or
- Have permission from the copyright owner, or
- Are legally permitted to use and distribute the content
Users must not assume that content is free to use simply because it is available online. Copyright protection may apply even if content does not include a copyright notice.
Users who submit infringing content may have their content removed, account access restricted, submission privileges suspended, or account terminated.
4. Content Policies
HappyMod aims to provide a safe and lawful platform experience. The following content is prohibited:
4.1 Copyright-Infringing Content
Content that copies, distributes, modifies, or makes available copyrighted works without permission is not allowed.
4.2 Circumvention of Access Controls
Content designed to bypass payment systems, subscriptions, licensing checks, digital rights management, server authentication, anti-piracy systems, or other technical protection measures is not allowed where such activity violates applicable law or the rights of the owner.
4.3 Misleading Ownership Claims
Users may not claim that they created, own, or have authorization to distribute content when they do not.
4.4 Unauthorized Branding or Impersonation
Content that uses another company’s name, logo, icon, brand identity, or developer identity in a misleading or unauthorized manner may be removed.
4.5 Harmful or Abusive Files
Content that contains malware, spyware, credential theft mechanisms, hidden tracking, unauthorized data collection, or other harmful behavior is prohibited and may also violate copyright, security, and user protection policies.
4.6 Repeat Uploads of Removed Content
Users may not reupload content that has been removed due to copyright infringement, unless they have obtained proper authorization or the removal decision has been reversed.
5. Review and Enforcement
HappyMod may review content for compliance with this Policy. Reviews may be triggered by:
- Copyright owner complaints
- User reports
- Internal moderation
- Automated detection systems
- Developer or publisher requests
- Legal obligations
When content is found to violate this Policy, HappyMod may take one or more of the following actions:
- Remove the content
- Disable access to the content
- Restrict visibility or distribution
- Remove related metadata, descriptions, images, or files
- Suspend or limit user submission privileges
- Terminate accounts involved in repeated or serious violations
- Preserve records where required for legal, security, or compliance purposes
HappyMod reserves the right to act without prior notice when necessary to protect rights holders, users, the platform, or legal compliance.
6. Copyright Holder Takedown Requests
Copyright owners or authorized representatives may submit a copyright removal request if they believe content available through HappyMod infringes their rights.
To help us review a request efficiently, the notice should include all of the following information:
-
Identification of the copyrighted work
- A clear description of the copyrighted work claimed to have been infringed.
- If multiple works are involved, provide a representative list.
-
Identification of the allegedly infringing content
- The name or title of the content on HappyMod.
- A description of where the content appears.
- Any relevant details that allow HappyMod to locate and review the material.
-
Statement of ownership or authorization
- A statement that the requester is the copyright owner or is authorized to act on behalf of the copyright owner.
-
Good-faith statement
- A statement that the requester has a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
-
Accuracy statement
- A statement that the information provided is accurate and complete.
-
Signature
- A physical or electronic signature of the copyright owner or authorized representative.
-
Requester information
- Sufficient identifying information for HappyMod to understand who is submitting the request and on whose behalf it is submitted.
Incomplete, unclear, or unsupported notices may result in delayed processing or no action being taken.
7. Processing Copyright Requests
After receiving a copyright removal request, HappyMod may:
- Review the submitted information
- Compare the claim with the identified content
- Request additional information if needed
- Remove or disable access to content when appropriate
- Notify the user who submitted the content, where appropriate
- Record the complaint for repeat-infringer enforcement
- Decline the request if it is incomplete, invalid, abusive, or unsupported
HappyMod may remove content when a request appears valid on its face. Removal does not necessarily mean that HappyMod has made a final legal determination regarding ownership or infringement.
8. Counter Notification Procedure
If a user believes their content was removed or disabled by mistake, misidentification, or because they have the legal right to use the content, the user may submit a counter notification.
A counter notification should include:
-
Identification of the removed content
- The name or title of the removed content.
- A description of where the content appeared before removal.
-
Statement of good faith
- A statement that the user has a good-faith belief that the content was removed or disabled due to mistake or misidentification.
-
Explanation of rights
- A clear explanation of why the user believes they have the right to upload, share, or distribute the content.
-
Accuracy statement
- A statement that the information provided is accurate and complete.
-
User signature
- A physical or electronic signature of the user.
-
User identification
- Sufficient identifying information to allow HappyMod to review the counter notification and match it to the removed content.
HappyMod may review counter notifications and, where appropriate, restore content if the original removal appears to have been made in error or if the dispute is resolved. HappyMod may decline to restore content if the counter notification is incomplete, unsupported, abusive, or inconsistent with policy or law.
9. Repeat Infringer Policy
HappyMod may suspend or terminate users who repeatedly submit or distribute content that infringes copyright or violates this Policy.
Repeat infringement may include:
- Multiple valid takedown requests against the same user
- Reuploading removed content
- Creating new accounts to bypass enforcement
- Submitting modified versions of removed content to avoid detection
- Providing false ownership claims
- Encouraging others to distribute infringing content
Enforcement may occur even if each individual violation involves different copyrighted works or different rights holders.
10. False or Abusive Reports
HappyMod does not allow misuse of the copyright reporting process.
Copyright requests may be rejected if they:
- Contain false or misleading information
- Target content the requester does not own or control
- Are submitted to suppress criticism, competition, commentary, or lawful use
- Are incomplete or impossible to verify
- Are repetitive, abusive, or submitted in bad faith
Submitting false claims may result in loss of reporting privileges and may expose the requester to legal responsibility under applicable laws.
11. Fair Use and Lawful Exceptions
Some uses of copyrighted material may be permitted by law, including fair use, fair dealing, commentary, criticism, education, research, interoperability, backup use, or other lawful exceptions depending on the jurisdiction.
HappyMod may consider these issues when reviewing copyright claims, but copyright disputes can involve complex legal questions. HappyMod is not a court and does not provide legal determinations regarding fair use or ownership. Users and rights holders are responsible for understanding their own rights and obligations.
12. Developer and Publisher Rights
HappyMod respects the work of app developers, game studios, publishers, artists, writers, musicians, and other creators.
Rights holders may request removal of content that:
- Reproduces their copyrighted work without authorization
- Distributes modified versions without permission
- Uses protected assets without authorization
- Confuses users about source, ownership, or endorsement
- Violates licensing terms or distribution restrictions
- Interferes with paid features, subscriptions, or monetization systems in an unlawful manner
HappyMod may take action to remove or restrict such content when appropriate.
13. No Transfer of Ownership
Submitting content to HappyMod does not transfer copyright ownership to HappyMod.
Users retain any rights they lawfully own, but they are responsible for ensuring they have the necessary permissions to submit and distribute the content. By submitting content, users represent that they have the legal right to do so and that their submission does not violate the rights of any third party.
14. Metadata, Images, and Descriptions
Copyright concerns may apply not only to files, but also to related materials such as:
- App names
- Icons
- Screenshots
- Feature images
- Descriptions
- Logos
- Promotional images
- Videos
- Audio
- Developer names
- Package information
- Written reviews or summaries
HappyMod may remove or modify metadata or supporting materials if they infringe rights, mislead users, or violate this Policy.
15. Content Removal Does Not Waive Rights
If HappyMod removes or disables access to content, that action does not limit the rights of copyright owners, users, or other parties. Copyright owners may still pursue remedies available under applicable law. Users may still dispute a removal through appropriate procedures.
16. Preservation of Records
HappyMod may preserve records related to copyright requests, removed content, user submissions, counter notifications, and enforcement actions when necessary for compliance, dispute resolution, fraud prevention, security, or legal purposes.
17. Policy Updates
HappyMod may update this Copyright Policy from time to time to reflect changes in law, platform practices, content standards, or enforcement procedures.
Continued use of HappyMod after changes to this Policy means users accept the updated terms. Users are encouraged to review this Policy regularly.
18. Summary
HappyMod is committed to respecting intellectual property rights and maintaining a responsible platform. Users must only submit content they are legally allowed to share. Copyright owners may request removal of infringing content by providing clear and complete information. HappyMod may remove content, restrict accounts, and take other appropriate action to enforce this Policy.
